These terms and conditions ("User Terms") govern Your use of the Site, the Service, and the Application, as well as all content, products, and services made available to You on or through them, whether you access them using a computer or a mobile device. According to the Information Technology Act of 2000 and its amended laws, this document qualifies as an electronic record. No signature is required for this computer-generated document.

You accept these User Terms using KWIKTAXIKO or clicking "I ACCEPT". Before using the Site, please read and comprehend these User Terms. Do not use the Site or its services if you disagree with any of them. You and KWIKTAXIKO are in a legal agreement due to your use of the Services. These Terms supersede all past agreements with you. For whatever reason, KWIKTAXIKO may revoke these Terms or any Services for you at any moment. Additional terms for particular Services, such as event, activity, or promotion policies, may apply and will be made known to you. Supplemental terms are a part of the Terms for Services.

The privacy policy may be found at kwikpickers.com and is part of the User Terms. You consent to receive promotional emails and SMS notifications from KWIKTAXIKO.

It is expressly stated that corporate entities covered by the KWIKTAXIKO Corporate Terms of Use are not subject to these User Terms. However, these User Terms SHALL BE APPLICABLE TO ALL AUTHORIZED USERS TAKING "KWIKTAXIKO CORPORATE RIDES," i.e., for customers using rides under direct contracts between corporate organizations and KWIKTAXIKO.

1. Defining terms

All capitalized and defined terms are defined as follows by these user phrases:

(i) "Account" refers to the customer's Account on the KWIKTAXIKO application.

(ii) "Additional Fee" refers to any tolls, duties, interstate taxes, etc., incurred during the provision of the Services and owed to any third parties or governmental bodies for performing the Ride by Applicable Law.

(iii) "Applicable Laws" refers to any statutes, enactments, or acts of the legislature or the parliament, as well as laws, ordinances, rules, by-laws, regulations, notifications, guidelines, policies, directions, directives, and orders of any agency, tribunal, or court of the Indian government.

(iv) "Application" refers to the brand-new "KWIKTAXIKO" smartphone app from KWIKTAXIKO.

(v) "Convenience Fee" or "Access Fee" refers to the cost of using KWIKTAXIKO's value-added services, such as door-to-door service, customer support, and cashless payment options. Convenience costs also include admission fees charged by third parties to places like train stations and airports.

(vi) A "Cancellation Fee" is the cost you incur when cancelling a Ride or a reservation, as defined in Clause 7 of these User Terms and the Cancellation policy.

2. QUALIFICATION

To be "Eligible" to use the Services, the following prerequisites must be satisfied:

You are older than 18.

(ii) Legal contracts are permissible.

Suppose you reside in a country or territory where using the Service or having the legal capacity to sign agreements like these User Terms is restricted. In that case, you must adhere to age restrictions.

3. Opening an account

3.1 You acknowledge that entering your registration information and adhering to clause 3 are the only ways to register on the Site.

3.2 You are required to keep Your Registration Data current, accurate, complete, valid, and truthful. We are not liable for your false, inaccurate, out-of-date, or incomplete registration information.

3.3 Whether you or a third party initiates any Account activity or transactions, you are solely in charge of maintaining the privacy of Your Registration Data. You cannot transfer or sell your Account. If someone else uses Your password or Account, whether with or without Your knowledge, We are not responsible for any loss You might experience.

3.4 If We have reason to believe that the Registration Data or any other information you have provided is untrue or inaccurate, that Your Account's security has been compromised, or for any other reason We may deem just or equitable, We reserve the right to suspend or terminate Your Account instantly and indefinitely.

4. Reassurance of a reservation

4.1. KWIKTAXIKO will notify You via the Application, SMS, or email if the booking is confirmed or rejected based on vehicle availability at the pickup time and place. Once the reservation has been confirmed, double-check the information, including the pickup time and location, and call our call centre if necessary.

4.2. The Customer will receive an OTP on the Application following the booking they must give to the Driver. If the customer does not enter their OTP, the Driver will not begin services.

4.3. You are in charge of any delays brought on by your failure to examine the confirmation message you received via the Application, SMS, or email or to let KWIKTAXIKO know if any of the information was inaccurate.

4.4. Selected customers can use KWIKTAXIKO's "Guest Booking" feature. Such consumers are subject to these terms.

5. Payment

5.1. KWIKTAXIKO will calculate the cost of each Ride before starting it. KWIKTAXIKO's estimate and the Total Ride Fee may vary for various reasons. After the Ride, the customer must pay the total Total Ride fee.

5.2. You consent to give KWIKTAXIKO the full ride fee, including taxes, immediately following the Ride. Any balance from the due estimate must be paid to KWIKTAXIKO immediately.

The convenience Fee/Access Fee for value-added services provided as part of the Ride or otherwise is determined and modified by KWIKTAXIKO.

You consent to including the Additional Fee in the Total Ride Fee.

5.3. The Clause 7 Cancellation Fee must be included in the Total Ride Fee.

5.4. After the Ride, KWIKTAXIKO will provide a receipt for the total ride fee; however, you may request invoices from KWIKTAXIKO, the Driver, or the TPSP. Our website offers requests for invoices.

6. Refund policies

6.1. KWIKTAXIKO will inform the app whether a ride cancellation fee applies. You acknowledge a Cancellation Fee, as detailed at https://kwikpickers.com/info/faqs#Cancellations, and that You may cancel Your order for Services at any time. Before cancelling a booking or service request, the cancellation fee will be disclosed to you. The website or Application will alert you. By the payment conditions in Clause 6 of these conditions, you acknowledge and agree to pay the applicable cancellation fee as part of the total ride fee for the upcoming Ride, or you will pay the outstanding cancellation fee before scheduling the upcoming Ride.

In line with the table above, KWIKTAXIKO shall give a receipt for the Cancellation Fee, if any, due by You for each cancellation; however, You may request separate invoices from the TPSPs and KWIKTAXIKO for the Convenience Fee. Ask Support for copies of the invoices.

6.2. Upon levy, you are required to pay the cancellation fee. KWIKTAXIKO reserves the right to add your cancellation fee to the total ride cost of any subsequent rides.

6.3 Cancellation Fee payments are governed by clause 6 of these User Terms.

6.4. Clause 7 does not apply to corporate rides under the terms and conditions.
